PRIVACY AND DATA PROTECTION POLICY

Effective Date: January 2026 Organization: The Federation of Khoja Shia Ithna-Asheri Jamaats of Africa ("Africa Federation" or "AFED") Headquarters: AFED Tower, Dar es Salaam, Tanzania

1. Introduction

The Africa Federation (AFED) is a trans-national religious and social organization committed to safeguarding the privacy and personal data of our community members across Africa and the Indian Ocean. This policy outlines how we collect, use, store, and protect your information in compliance with the diverse legal frameworks of the countries in which we operate.

2. Scope and Legal Framework

This policy applies to all data collected by AFED and its constituent Jamaats. We operate in compliance with the following regional and national laws:

A. East Africa

  • Tanzania (HQ): The Personal Data Protection Act No. 11 of 2022.

  • Kenya: The Data Protection Act, 2019.

  • Uganda: The Data Protection and Privacy Act, 2019.

  • Rwanda: Law No. 058/2021 relating to the Protection of Personal Data and Privacy.

  • Burundi: Applicable provisions of the Law on the Prevention and Repression of Cybercriminality (2022) and sectoral privacy regulations.
     

B. Central & Southern Africa

  • Democratic Republic of Congo (DRC): The Digital Code (Law N°23-010 of 13 March 2023).

  • Malawi: The Data Protection Act, 2024.

  • Mozambique: The Electronic Transactions Law (Law no. 03/2017) and Constitutional Rights to Privacy.
     

C. Indian Ocean (AKSIAM & UAKSIR)

  • Madagascar: Law No. 2014-038 on the Protection of Personal Data.

  • Mauritius: The Data Protection Act 2017 (GDPR-aligned).

  • Reunion (France): The General Data Protection Regulation (EU) 2016/679 (GDPR).
     

3. Data We Collect
We collect data necessary to maintain community census, facilitate religious obligations, and manage events across our member Jamaats:

  • Personal Identity: Name, date of birth, gender, marital status, National ID/Passport.

  • Contact Details: Physical address (City/Country), email, phone numbers.

  • Religious & Census Data: Jamaat membership records, family tree linkages, and records of religious dues (Khums, Zakat, Sadaqah).

  • Sensitive Data: Health records (for Medical Board grants) and financial status (for Welfare/Education Board assistance).

  • Media: Photographs and video recordings from AFED events (e.g., AFTAB, Sports Festivals).
     

4. Purpose of Processing
Your data is processed for the following legitimate purposes:

  • Community Governance: Managing the census of the Khoja Shia Ithna-Asheri community across all listed territories.

  • Service Provision: Assessing eligibility for housing schemes, education loans (Education Board), and medical assistance (Health Board).

  • Event Management: Organizing conferences and festivals in hub cities (e.g., Nairobi, Dar es Salaam, Kinshasa, Antananarivo).

  • Communication: Distributing obituary notices, federation newsletters, and official circulars.
     

5. Media, Photography, and Events

  • Implied Consent: By attending AFED public events (including but not limited to conferences in Arusha/Mombasa or festivals in Madagascar), you consent to being photographed or filmed.

  • Usage: These images may be used for official AFED reports, publications, and social media channels.

  • Opt-Out: Individuals wishing to avoid photography must inform the event Secretariat upon arrival. Requests for removal of specific images from digital galleries can be made to secretariat@africafederation.org.
     

6. International Data Transfers & Strategic Partners
As a global federation, AFED may share necessary data with our "Strategic Partners" for census unification, higher education support, or philanthropic collaboration. All transfers are conducted with strict confidentiality safeguards:

  • The World Federation (UK): Transfers are subject to UK GDPR adequacy standards.

  • COEJ Federation (Council of European Jamaats): Located in the UK/Europe; data sharing is limited to census and welfare coordination, compliant with GDPR.

  • NASIMCO Federation (North America): Located in the USA/Canada; data sharing is limited to cross-border family census and educational grants, compliant with North American privacy standards.
     

7. Data Security
We employ technical and organizational measures to protect your data, including encrypted databases and restricted access protocols for sensitive welfare and health data. Access is granted strictly on a "need-to-know" basis to authorized office bearers in your local Jamaat and the AFED Secretariat.

8. Your Rights
Subject to the laws of your specific jurisdiction, you have the right to:

  • Access: Request a copy of the data AFED holds about you.

  • Correction: Update incorrect information (e.g., change of address from Bujumbura to Kampala).

  • Erasure: Request deletion of data where it is no longer necessary (Right to be Forgotten), subject to religious record-keeping requirements.

  • Objection: Object to specific processing activities.
