EXTRA ORDINARY CONSITUTIONAL CONFERENCE– 2008

 

The Extra Ordinary Constitutional Conference was called preceding the 67th Supreme Council Session of the Africa Federation on Friday 21st March 2008 in Dar-es-Salaam Tanzania.

 

This Conference was the culmination of the Resolution which was passed at the 22nd Triennial Conference in 2004, which recognized the need to have the Federation Constitution Reviewed. A Committee was established with Alhaj Amir Bhai Somji as the Chairman of this Committee.

 

At the same conference, Alhaj Shabbir Najafi (Kampala), Alhaj Mohamed Nathoo (Dar-es-Salaam) Alhaj Dr Asghar Moledina (Maputo) Alhaj Abdulrazak Khalfan (Nairobi) and Alhaj Ikbal Sounderji (Antananarivo) were also appointed to sit on this committee.

 

The completion of this process was delayed due to various reasons and a new mandate was given to the Committee at the 23rd Triennial Conference.  Alhaj Mohamed Hemani (Mombasa), Alhaj Amir Merali (Mombasa), Alhaj Mohamed Pardhan (Dsm - Legal Advisor), Alhaj Saqlayn Meghji (UK – Legal Advisor) and Mukhtar Assaria (AF Secretariat) were co-opted to assist his committee.

 

The Proposed Draft Document was circulated to the Constituent Jamaats for their feedback in January 2008.

 

In the Chairman’s Address at the commencement of the Conference, he mentioned that this need was first identified in 1998. However for some reason or the other a complete review was never tabled for consideration.

 

The Conference considered that the Proposed Draft Constitution was prepared out of mandate of the Resolution and hence the Constitution Review Committee was given a new tenure to further look into the same giving due consideration to the feedback received from constituent Jamaats.

 

It was concluded by according the committee another 150 Days from 23rd March 2008, to finalize the document and present it to the Secretariat of the Africa Federation by way of report confirming to the requirement of the original resolution.
